Terms & Conditions

These Terms & Conditions apply when you access BuyerReport, upload an inspection report, purchase a report review, subscribe to a BuyerReport plan or otherwise use our website and services.

Please read these terms before using BuyerReport.

By accessing or purchasing a BuyerReport service, you agree to these Terms & Conditions. BuyerReport reviews information contained within inspection reports supplied by users. BuyerReport does not perform a new physical inspection of the property unless expressly stated otherwise.

01

Acceptance of These Terms

By using the BuyerReport website, application or services, you acknowledge that you have read, understood and agree to be bound by these Terms & Conditions.

If you do not agree with these terms, you should not purchase or use the BuyerReport service.

02

About the BuyerReport Service

BuyerReport provides review and interpretation services for existing building inspection, timber pest, building and pest, property inspection and similar reports supplied by the user.

Depending on the service selected, BuyerReport may provide:

  • AI-generated analysis of an uploaded inspection report;
  • a separate professional review of the supplied report by an experienced building inspector;
  • indicative repair-cost guidance;
  • defect prioritisation and explanations;
  • identification of items that may warrant further investigation;
  • practical buyer-focused information;
  • a consultation where included in the service purchased.
BuyerReport is a report-review service.

Unless expressly stated otherwise, BuyerReport does not physically attend or inspect the property and does not replace the inspection completed by the original building or timber pest inspector.

03

Information You Supply

BuyerReport relies on the documents, photographs, information and other material supplied by you.

You are responsible for ensuring that the documents uploaded are complete, accurate and relevant to the property you want reviewed.

BuyerReport cannot assess defects, areas, conditions or information that are not contained within, visible in or reasonably apparent from the supplied material.

Where pages, photographs, attachments or sections of the original inspection report are missing, the resulting BuyerReport review may also be incomplete.

04

AI Report Reviews

BuyerReport offers an automated AI Report Review service.

AI-generated content is produced using automated systems that analyse the inspection report supplied by the user.

AI systems can make mistakes, misunderstand technical information, omit relevant details or produce information that requires further verification.

Unless a Professional Inspector Review has been separately purchased, an AI Report Review is not independently reviewed or approved by a building inspector before release.

AI Report Reviews are provided as general informational assistance and should be considered together with the original inspection report.

The original inspection report remains important.

The BuyerReport AI Review does not replace the findings, qualifications, definitions, limitations or recommendations made by the inspector who physically attended the property.

05

Professional Inspector Reviews

Where you purchase a Professional Inspector Review, an experienced building inspector separately reviews the original inspection report supplied by you.

The Professional Inspector Review is a desktop review of the supplied report and information.

It is not a new physical inspection of the property.

The reviewing inspector may provide additional context regarding defect significance, repair priorities, likely trades, indicative repair costs and matters that may warrant further investigation.

The review remains subject to the information and limitations of the original supplied report.

06

Professional Review + Consultation

Where your purchased service includes a consultation, the consultation is intended to discuss the supplied inspection report and BuyerReport review.

Consultations do not constitute another physical inspection of the property and are limited to the information reasonably available during the consultation.

Consultation time is limited to the duration included with the product purchased.

07

Original Inspection Report

BuyerReport does not assume responsibility for the accuracy, completeness or quality of an inspection carried out by another inspector or inspection company.

Where there is a difference between the wording of the original inspector and a BuyerReport interpretation, users should consider the original inspector's findings and seek clarification from the original inspector where appropriate.

The original inspector physically attended the property and may have information, observations or context that is not apparent from the written report alone.

08

Repair-Cost Guidance

Where BuyerReport provides repair-cost information, those figures are indicative budgeting allowances only.

They are not contractor quotations, fixed prices or guarantees of the final repair cost.

Actual costs can vary depending on factors including:

  • the final scope of work;
  • the extent of concealed damage;
  • access to the affected area;
  • materials selected;
  • labour costs;
  • property location;
  • contractor availability;
  • additional defects discovered during repair work.

Where the likely cost is material to your purchasing decision, you should obtain quotations from suitable contractors before relying on a particular repair budget.

09

Further Investigation

BuyerReport may recommend further investigation where the supplied report contains uncertainty regarding a defect, its cause, extent or likely repair requirement.

Depending on the issue, further assessment may be required by an appropriate contractor, technician, specialist or other suitably qualified person.

You are responsible for arranging any further investigation that you consider necessary before making a property decision.

10

Property Purchasing Decisions

BuyerReport provides information intended to assist you in understanding an inspection report.

BuyerReport does not decide whether you should purchase, reject, negotiate on or otherwise proceed with a property.

Property purchasing decisions remain entirely your responsibility.

You should consider all information relevant to the transaction, including the original inspection report, contract conditions, finance, valuation, professional advice and your own circumstances.

11

No Legal, Conveyancing or Financial Advice

BuyerReport does not provide legal, conveyancing, settlement, financial, taxation or investment advice.

Any information concerning negotiation, contract conditions, property transactions or possible buyer options is general information only.

Where legal rights, contract conditions, settlement matters or financial consequences are important, you should seek advice from an appropriately qualified professional.

12

Prices and Payments

Prices displayed on the BuyerReport website or application are the prices applicable at the time of purchase unless otherwise stated.

BuyerReport currently offers services including:

  • AI Report Review;
  • Professional Inspector Review;
  • Professional Review + Consultation;
  • Unlimited AI Review subscription plans.

Prices may change from time to time. A price change does not retrospectively alter a completed one-off purchase.

Payments may be processed through third-party payment providers, including Stripe.

13

Refunds

Refund requests are considered in accordance with these Terms and applicable Australian Consumer Law.

Because automated report processing may begin shortly after payment and upload, a change-of-mind refund may not be available once processing has commenced or the completed service has been supplied.

Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded under Australian Consumer Law.

14

Unlimited AI Review Subscriptions

BuyerReport may offer a monthly subscription providing access to unlimited AI Report Reviews subject to reasonable fair use.

The subscription is intended for normal use by buyers, investors, buyer's agents and property professionals reviewing legitimate property inspection reports.

Unlimited access does not mean unrestricted automated, abusive, bulk, resale or system-generated use.

BuyerReport may contact a subscriber or temporarily restrict access where usage is unusually high, automated, abusive or inconsistent with reasonable use of the service.

A monthly AI subscription does not include a Professional Inspector Review or professional consultation unless specifically stated.

15

Subscription Billing and Cancellation

Monthly subscriptions are billed on a recurring basis until cancelled.

You may cancel your subscription before the next billing date to prevent the next recurring charge.

Cancellation stops future renewal but does not ordinarily provide a retrospective refund for a billing period already commenced, except where required by law.

16

Delivery Times

Any stated processing or delivery time is an estimate unless BuyerReport expressly guarantees a particular timeframe.

AI reviews are generally processed quickly, but processing times may be affected by report size, system demand, technical problems or other circumstances.

Professional reviews require human review and may therefore take longer.

17

Uploaded Documents and Permission to Process

By uploading a report or other material, you confirm that you have lawful authority to provide that material to BuyerReport for the purpose of receiving the service.

You grant BuyerReport permission to process, analyse and store the uploaded material to the extent reasonably necessary to provide the service.

18

Privacy and Data

BuyerReport handles personal information in accordance with its Privacy Policy.

Uploaded inspection reports may contain personal or property-related information. You should avoid uploading information that is not reasonably necessary for the service.

For more information, please read our Privacy Policy .

19

Acceptable Use

You must not use BuyerReport:

  • for unlawful purposes;
  • to upload material you are not authorised to use;
  • to interfere with or attempt to compromise BuyerReport systems;
  • to conduct automated scraping or abusive bulk processing;
  • to reproduce or resell BuyerReport services in a misleading manner;
  • to impersonate another person or organisation.
20

Intellectual Property

BuyerReport owns or licenses the website design, software, report formats, written materials, branding, processes and other intellectual property used to operate the service.

Purchasing a BuyerReport service does not transfer ownership of BuyerReport intellectual property to you.

You may use a completed BuyerReport review for your own legitimate property-purchasing or business purposes, but you must not copy, reproduce, republish or commercially exploit BuyerReport systems, templates or content without permission.

21

Third-Party Services

BuyerReport may rely on third-party services for payment processing, hosting, artificial intelligence, communications and other technical functions.

BuyerReport is not responsible for temporary interruptions caused by circumstances outside its reasonable control.

22

Limitation of Liability

To the maximum extent permitted by law, BuyerReport is not liable for loss arising solely from information that was missing, inaccurate, concealed or unavailable within the original inspection report or other material supplied by the user.

BuyerReport is also not responsible for defects or property conditions that could not reasonably be identified from the supplied documents.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, statutory right or remedy that cannot legally be excluded or restricted.

23

No Guarantee of Property Condition

BuyerReport does not guarantee that a property is free from defects, termite activity, moisture, deterioration, safety hazards or other conditions.

BuyerReport also does not guarantee that every defect will be identified in the supplied report or subsequent BuyerReport review.

24

Changes to the Service

BuyerReport may update, improve or change features, products, prices and service arrangements from time to time.

BuyerReport may also update these Terms & Conditions where reasonably necessary.

Updated terms will apply from the date they are published unless otherwise stated.

25

Governing Law

These Terms & Conditions are governed by the laws applicable in Western Australia and the Commonwealth of Australia.

Subject to any rights that cannot lawfully be limited, disputes relating to these Terms or the BuyerReport service will be subject to the jurisdiction of the courts and tribunals having jurisdiction in Western Australia.
